123 Psychiatry (“we”, “us” or “our”) operates https://www.123psychiatry.com/ (the “Website”). This Privacy Policy explains what information we collect through the Website, how we use it, who we share it with, and the choices you have. It applies to the Website only.

Patient information is governed separately. Information you share with us as a patient in the course of evaluation or treatment is protected health information covered by HIPAA and our Notice of Privacy Practices, which we give you at intake. If anything in this Privacy Policy conflicts with that Notice, the Notice controls for protected health information.

1. Information we collect

Information you give us

When you use a contact form, request an appointment, refer a patient, or message us through live chat, we receive what you type: typically your name, telephone number, email address and your message. Please do not include detailed clinical information, insurance numbers or medication lists in website forms or chat; for clinical matters, call our office directly.

Information collected automatically

When you visit, our web server and hosting provider record technical information needed to deliver and secure the Website: your IP address, browser type, the pages requested, referring page and the date and time of each request. These server logs are kept for security and troubleshooting and are not shared with advertising or analytics companies.

With your permission only, the optional tools described in Section 3 may also collect device information, the pages you view, how long you stay, and how you scroll and click.

2. Health-related information about your visit

Because we are a mental health practice, the fact that you visited this Website, the condition or service pages you read, and the contents of any inquiry you send may reveal information about your health. We treat that information as consumer health data and apply the additional protections described in our Consumer Health Data Privacy Notice, including not sharing it with any third-party analytics, session-recording or chat provider unless you have turned that tool on in Sharing settings.

3. Cookies and tracking technologies: you decide

When you first visit, a notice at the bottom of the page lets you choose which technologies may run. Nothing in the optional categories loads, and nothing about your visit is transmitted to the companies that provide them, until you make a choice. You can change your choice at any time through the Sharing settings link in the footer of every page.

A full list of the cookies each category may set is in our Cookie & Tracking Technologies Notice.

4. How we use information

  • To respond to your inquiries and appointment or referral requests.
  • To operate, secure, maintain and troubleshoot the Website.
  • With your permission, to understand how the Website is used and improve it.
  • To comply with legal obligations and to establish, exercise or defend legal claims.

We do not use information collected through the Website to make automated decisions about you, to build a profile of your health, or to market treatments to you.

5. How we share information

  • Service providers that process information on our behalf and under contract, such as our web host, email provider and appointment-scheduling software. They may use the information only to provide their service to us.
  • Optional tool providers listed in Section 3, only for the categories you have turned on in Sharing settings.
  • Legal requirements, when disclosure is required by law, subpoena or court order, or to protect the rights, property or safety of our practice, our patients or others.
  • Business transfers, if our practice is merged, acquired or reorganized, subject to this Privacy Policy.

We do not sell personal information, and we do not share it for cross-context behavioral advertising. We do not disclose protected health information through the Website or through any of the tools described above.

6. Your choices and rights

Sharing settings. Use the Sharing settings link in the footer to turn optional tools on or off at any time. Your choice is stored in a cookie on your device.

Global Privacy Control. If your browser sends a GPC signal we treat it as a request to opt out of the sale or sharing of your personal information, and advertising technologies remain off.

Browser controls. Most browsers let you block or delete cookies. Blocking essential cookies may prevent parts of the Website from working.

Provider opt-outs. Google offers a browser add-on to block Google Analytics everywhere. Microsoft describes its practices in the Microsoft Privacy Statement.

Rights under state privacy laws. Depending on where you live (including California, Colorado, Connecticut, Delaware, New Jersey, New York, Oregon, Texas, Virginia, Washington and other states with comprehensive privacy or consumer health data laws), you may have the right to:

  • confirm whether we process your personal information and access a copy of it;
  • correct inaccurate personal information;
  • delete personal information we hold about you;
  • receive your information in a portable format;
  • opt out of the sale or sharing of personal information, targeted advertising and profiling (we do none of these);
  • withdraw consent you previously gave for the collection of consumer health data; and
  • appeal a decision we make about your request, and not be discriminated against for exercising your rights.

To exercise any of these rights, use the form on our Your Privacy Choices page, email info@123psychiatry.com, or call (973) 600-5465. We may need to verify your identity before acting, and an authorized agent may submit a request on your behalf with proof of authorization. We respond within 45 days, and may extend once by 45 days where permitted by law with notice to you. If we decline your request, you may appeal by replying to our decision with the word “Appeal” in the subject line.

7. Children

The Website is not directed to children under 13 and we do not knowingly collect personal information from them through it. Parents or guardians seeking care for a minor should contact our office directly.

8. Security

We use reasonable administrative, technical and physical safeguards, including encryption in transit (HTTPS) and access controls, to protect information collected through the Website. No method of transmission over the internet is completely secure, so please use the telephone for sensitive matters.

9. Retention

We keep inquiry messages for as long as needed to respond and for a reasonable period afterwards for record-keeping. Server logs are kept for a limited period for security purposes. Your consent choice is stored for up to 12 months. Analytics data, where you allow it, is retained according to the provider’s settings, which we have set to the shortest available period.

10. Links to other websites

The Website may link to patient portals, insurers, telehealth platforms or other websites we do not control. Their privacy practices are governed by their own policies.

11. Changes to this Privacy Policy

We will post any changes on this page with a new effective date. If we add a new optional tool or materially change how information is shared, the consent notice will be shown again so you can make a new choice.
